Introduction:

The rule of law is a fundamental principle that underpins the functioning of any democratic society. It is a concept that ensures fairness, justice, and equality in the application and interpretation of the law. In Zambia, as in many other countries, the rule of law is enshrined in the constitution and is a guiding principle for all administrative actions. However, the practical implementation of this principle often presents numerous challenges, particularly in relation to transparency and accountability in administrative decision-making.

This dissertation aims to critically assess the mechanisms and tools that are currently in place to promote transparency and accountability in administrative decision-making in Zambia. It seeks to explore the effectiveness of these mechanisms and tools, and to identify any gaps or shortcomings that may exist. The study will also propose recommendations for improving the current situation, with a view to enhancing the rule of law in Zambia.

Background:

Zambia, like many other African countries, has been grappling with issues of corruption, lack of transparency, and accountability in public administration. These issues have not only undermined the rule of law but have also hindered the country's socio-economic development. Over the years, various mechanisms and tools have been put in place to address these challenges. These include the enactment of legislation, the establishment of oversight bodies, and the adoption of various administrative procedures and practices.

However, despite these efforts, transparency and accountability in administrative decision-making remain a significant challenge. There are concerns that the existing mechanisms and tools are not sufficiently effective, and that there is a lack of political will to fully implement and enforce them. Furthermore, there are concerns about the capacity of citizens to hold public officials accountable, due to factors such as lack of information, lack of awareness of their rights, and fear of reprisals.

This dissertation will therefore undertake a critical assessment of the current situation in Zambia, with a view to identifying the key challenges and proposing practical solutions. The study will draw on a range of sources, including legislation, case law, academic literature, and reports from oversight bodies and civil society organizations. It will also seek to draw lessons from other jurisdictions that have successfully addressed similar challenges.
