Solution

The Unlawful Activities Prevention Act (UAPA) is an Indian law aimed at effective prevention of unlawful activities associations in India. Its main objective was to make powers available for dealing with activities directed against the integrity and sovereignty of India.

The Act was first enacted in the year 1967, and it has been amended several times since then. The most recent amendment came in the year 2019.

Under UAPA, both Indian and foreign nationals can be charged. It will be applicable to the offenders in the same manner, even if crime is committed on a foreign land, outside India.

The UAPA, originally passed in 1967, was strengthened in 2008 following the Mumbai attacks. The law was further amended in 2019 to include the provision of designating an individual as a terrorist, prior to this only organizations could be designated as terrorist organizations.

The Act has stringent provisions for the punishment of those involved in terrorist activities, unlawful activities, being part of a terrorist gang or organization, holding proceeds of terrorism, and for dealing with terrorist activities directed outside India.

However, the Act has also been criticized for its potential misuse against political dissidents and minorities. Critics argue that the law could be used to target individuals who disagree with the ruling government's ideologies, thereby stifling dissent and opposition.
