A licensee does NOT commit the offence of permitting intoxication if it is proven that: They took all of the steps set out in the Prevention of Intoxication on Licensed Premises Guidelines issued under the liquor laws They had free drinking water available at all times at each bar All staff had completed mandatory RSA training Free snack food was available when liquor was being served

The Act prohibits this on the grounds of protected characteristics.

15) A license cannot be obtained by someone who has been convicted of an offence listed in the Criminal Record Regulation unless a pardon has been given.
